CITY COUNCIL MEETING MINUTES
MONDAY, APRIL 16, 2007 - 6:30 P.M.

The regular scheduled Council meeting of Monday, April 16, 2007 was called to order by Mayor Gary W. Manier in the Training Room at Fire Station No. 1 at 6:30 p.m.

Answering present for Roll Call were Aldermen Dave Dingledine, Jim Gee, Bob Brucks, Jim Newman and Don Brubaker. Aldermen absent included Dennis Landry, Al Howerter and Todd Clanin.

Also present was City Attorney Kenneth L. Black, City Administrator Bob Morris, Controller Joanie Baxter, Chief of Police Jim Kuchenbecker and City Clerk Carol Moss, members of the press, David Knight, Michael Chiras and Carol Tiggelaar, Vice President of Community Affairs on behalf of the National Association for the Education of Young Children.

Mayor Manier asked those present to stand for the Pledge of Allegiance and he also asked that a moment of silence be observed for the victims and their families involved in the Virginia Tech shootings. The Agenda was reviewed and Administrator Morris indicated that there will not be a report from the Washington Chamber of Commerce. Representatives will be present for the May 7 meeting.

Alderman Brucks moved and Alderman Brubaker seconded to approve the Consent Agenda as presented. Mayor Manier read a proclamation proclaiming the week of April 22-28, 2007 as Week of the Young Child. Items included in the Consent Agenda were minutes of the April 2, 2007 Council meeting, Bills & Payroll in the amount of $803,463.65, proclamation proclaiming the month of May as Motorcycle Awareness Month, a proclamation proclaiming the week of April 22-28, 2007 as Week of the Young Child, and a pay request from WACC in the amount of $170,000. 
On roll call on the motion to approve the vote was: 
Ayes: 5 Dingledine, Newman, Gee, Brubaker, Brucks 
Nays: 0 
Motion declared carried.

There were no Audience Comments or Standing Committee Reports.

City Attorney Black read, by title only, a Resolution confirming City Attorney appointments and establishing attorneys' fees. Alderman Dingledine moved and Alderman Brucks seconded to adopt the resolution as read. If approved, Kenneth L. Black will be appointed as City Attorney with Robert W. Brown Jr. and David A. Brown as assistants. Compensation for time spent on City matters will be at a rate of $140.00 per hour, effective May 1, 2007.

City Attorney Black provided second reading of an ordinance adopting a Budget for corporate purposes for the fiscal year beginning May 1, 2007 and ending April 30, 2008 and approving certain amendments to the FY06-07 budget. Alderman Brubaker moved and Alderman Dingledine seconded to adopt the ordinance as read. 
On roll call the vote was: 
Ayes: 6 Brucks, Gee, Newman, Dingledine, Brubaker, Mayor Manier 
Nays: 0 
Motion declared carried.

Mayor Manier read a resignation letter from Waylon Smith that Smith was resigning from ESDA as well as from the Auxiliary Police. Mayor Manier noted that nine other ESDA members resigned shortly after Smith's resignation and ask that those resignations be accepted by the Council. Alderman Newman moved and Alderman Gee seconded to accept the ESDA resignations that were received.

Mayor Manier indicated that he would like to appoint Chief of Police Kuchenbecker as ESDA Coordinator and Alderman Brubaker moved and Alderman Gee seconded to appoint Chief Kuchenbecker as ESDA Coordinator.

City Administrator Morris requested Council approval of the FY07-08 Pay Plan. He reported this includes a 3.8% pay increase across all steps/ranges for non-union employees. Compensation for unionized police officers will in accordance with the terms of the existing collective bargaining agreement, and compensation for unionized telecommunicators and public services employees will remain unchanged pending resolution of contract negotiations. Alderman Gee moved and Alderman Brubaker seconded to approve FY07-08 Pay Plan.

Controller Baxter requested Council authorization to write-off $8218.13 uncollectible water and sewer receivables. These accounts were sent to collection in September, 2006 and are now being recommended for write-off as of April 30, 2007. Controller Baxter reported that the City continues to have a very high collection rate. The write-off represents a total of .33% and .37% of water and sewer billings, respectively. Alderman Brucks moved and Alderman Dingledine seconded to approve the write-off of uncollectible accounts receivable as requested.

Aldermen's Comments - Alderman Brubaker told Mayor Manier that he is one hundred percent behind the Mayor, City Administrator and Chief of Police regarding discussion and exchanges at the Committee of the Whole meeting last Monday pertaining to ESDA. He said he is not speaking for any other members of the Council, only for himself.

At 6:44 p.m. Alderman Dingledine moved and Alderman Brucks seconded to move into Executive Session for the purpose of deliberations concerning the appointment, employment, compensation, discipline, performance or dismissal of specific employees of the public body per 5ILCS 120-/2(c)(1) of the Illinois Open Meetings Act. 
On roll call the vote was: 
Ayes: 5 Brubaker, Gee, Newman, Brucks, Dingledine 
Nays: 0 
Motion declared carried.

At 7:34 p.m. the Council returned to regular session and Alderman Brucks moved and Alderman Dingledine seconded to adjourn. Motion carried unanimously by voice vote.
